Insolvency law and bankruptcy

Insolvency law is one of the cornerstones of our business. Two of our lawyers are experienced court appointed trustees, dealing with large bankruptcies on a regular basis. This gives us a unique insight into how businesses work or fail. We help our clients with restructuring and liaise with all parties involved, such as banks, the Dutch tax authorities and other (secured) creditors. If the company cannot be saved, then we advise on responsible methods of liquidation.

For foreign clients involved with the bankruptcy of a debtor, we can liaise with the trustee to assert their rights and exercise any securities that may have been granted by the bankrupt company.

Our areas of expertise include:

  • Bankruptcy;
  • Suspension of payments (moratorium);
  • Debt restructuring;
  • Reorganisation of personnel;
  • Shareholder agreements;
  • Director's liability;
  • Takeover negotiations/ Management buy outs;
  • Turnaround;
  • Vesting and enforcement of securities;

Our contact person for Insolvency law and bankruptcy is Maria Bowmer, a member of INSOLAD, the Dutch association of specialised insolvency lawyers. Please feel free to contact her for more information.
